IDDC Video and Photo Terms of Service

PLEASE READ THESE TERMS OF USE CAREFULLY. The Indiana Destination Development Corporation MAKES A WEBSITE AVAILABLE THAT IS LOCATED AT VisitIndiana.com AND ALSO CERTAIN CONTENT THAT IS AVAILABLE ON THAT WEBSITE AND ANY SUBDOMAINS USED IN CONNECTION WITH OR RELATED TO THE SAME (COLLECTIVELY, THE "MEDIA HUB" OR "Media Hub"). THESE TERMS OF USE APPLY TO ALL USERS OF THE MEDIA HUB AND/OR THE CONTENT, INCLUDING USERS WHO DOWNLOAD ANY CONTENT FROM THE MEDIA HUB AND USERS WHO VIEW CONTENT ON OR AVAILABLE THROUGH THE MEDIA HUB.  

YOU MUST BE AT LEAST EIGHTEEN (18) YEARS OLD TO USE THE MEDIA HUB. BY ACCESSING, BROWSING AND USING THE MEDIA HUB, YOU INDICATE THAT YOU HAVE READ AND ACCEPT THESE TERMS OF USE. IF YOU DO NOT ACCEPT THESE TERMS OF USE, DO NOT USE THE MEDIA HUB OR ANY OF ITS CONTENT. THE TERM "YOU" OR "YOUR" REFERS TO THE INDIVIDUAL OR LEGAL ENTITY, AS APPLICABLE, USING THE MEDIA HUB. IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS OF USE, DO NOT ACCESS OR USE THE MEDIA HUB OR THE CONTENT ON THE MEDIA HUB. 

IF YOU ARE ACCEPTING THESE TERMS OF USE ON BEHALF OF A CORPORATION OR OTHER ENTITY, YOU REPRESENT AND WARRANT THAT YOU HAVE THE NECESSARY RIGHT AND AUTHORITY TO ENTER INTO THESE TERMS OF USE ON BEHALF SUCH CORPORATION OR ENTITY AND TO BIND SUCH CORPORATION OR ENTITY TO THESE TERMS OF USE.

PLEASE NOTE THAT THESE TERMS OF USE ARE SUBJECT TO CHANGE BY US AT OUR SOLE DISCRETION AT ANY TIME. WHEN CHANGES ARE MADE, WE WILL MAKE A NEW COPY OF THE TERMS OF USE AVAILABLE.

Grant of License. We grant You a free, personal, limited, terminable, non-transferable, non-sublicensable and non-exclusive license to use the Content subject to the following conditions:

Exploitation of Content is limited to non-commercial uses only and for the specific purpose of promoting ___________ as a travel destination;

Content shall not in any way be used to sell or resell promotional items or for commercial gain;

Content shall include the appropriate credits (name of photographer or owner of the copyright in the licensed photograph) as supplied by via the Media Hub, and these credits shall be clearly identifiable;

By granting this usage, we do not in any way transfer any intellectual property rights in the Content to You;

You agree that You will not authorize any third party to use any Content without Our prior written authorization and

You acknowledge that We do not own the rights to user-generated Content that You find on the Media Hub.

Any use of content for purposes other than those outlined in this license is strictly prohibited unless prior written authorization is obtained from Us.

Advertising. You acknowledge and agree that the Media Hub may contain advertisements. If you elect to have any business dealings with anyone whose products or services may be advertised on the Media Hub. In that case, You acknowledge and agree that such dealings are solely between You and such advertiser. You further acknowledge and agree that We and Our licensors and platform providers shall not have any responsibility or liability for any losses or damages that You may incur as a result of any such dealings.

In addition:

 You may use these photos/videos explicitly to promote the State of Indiana and any location within it. You may not use these photos to disparage Indiana or in a manner which, in IDDC's sole discretion, may diminish or tarnish IDDC's goodwill.

You may not alter these photos/videos in any major way including cropping the photo in a way that removes the IN Indiana identifier (The text in the corner), flipping the photo, adding graphics to the photo or video, or animating the photo in any way. You may make slight alterations to photos such as color correction, slightly rotating the photo, or cropping the photo in a way that doesn't remove the IN Indiana identifier. IDDC has sole discretion in which changes are considered major and therefore are in violation of the agreement.

You may not hide, cover, or obscure the IN Indiana Identifier when using these photos. Any usage that affects the readability of the IN Indiana Identifier is considered a violation of the agreement.

You may not use these photos in any way that implies that IDDC sponsors, supports, or endorses your organization, viewpoints, or content without prior written consent.

By using these photos, you acknowledge that all rights to these photos are the exclusive property of IDDC and can be withdrawn without warning with IDDC's sole discretion.

This photos and video may not be resold for any reason.

By using these photos, you agree to not take any action that would undermine the IDDC's rights or ownership of these photos.

Users must not include inappropriate language or be used to make a social or political statement with these photos. More specifically, users will not include:

Any unlawful, threatening, abusive, libelous, defamatory, discriminatory, obscene, vulgar, pornographic, profane, or indecent information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any local, state, national or international law; or, Any harassing or offensive language, sexual references, sexual nicknames, racial slurs or rude or deliberately offensive comments.

Users must comply with these Terms of Use. Any deviation from the Terms of Use must be approved by IDDC in advance and in writing, and any such requests will be reviewed on an item-by-item basis. Please contact permission@iddc.IN.gov for more information or questions about the Terms of Use.

By checking the box, those downloading photos or videos agree to use it consistent with the Terms of Use. Anyone who violates the Terms of Use will be denied access.
